MongThai User Agreement

Welcome to the "MongThai" application (hereinafter referred to as "this App" or "this Service"), operated by Taifong Huaye Co., Ltd. (hereinafter referred to as "We," "Us," or "the Company"). This App aims to provide users with convenient browsing, booking, and related services for travel products in Thailand and globally.

Please carefully read, fully understand, and agree to all terms and conditions of this "MongThai User Agreement" (hereinafter referred to as "this Agreement"), especially the clauses concerning exemption or limitation of liability, applicable law, and dispute resolution, before registering as a MongThai user or using this Service. When you click the "Agree," "Register" button, actually use this Service, or otherwise expressly or implicitly indicate your acceptance of this Agreement, you are deemed to have fully read, understood, and accepted all contents of this Agreement and have reached an agreement with Taifong Huaye Co., Ltd. This Agreement is legally binding on both you and the Company.

If you are under 18 years of age (or the legal age of majority stipulated by Thai law), please read this Agreement accompanied by a legal guardian, paying special attention to the terms regarding use by minors.

I. Definitions

  1. MongThai/This App/This Service: Refers to the mobile application named "MongThai" developed and operated by Taifong Huaye Co., Ltd., as well as various services provided to you through this App, such as the display, search, and booking of travel product information.
  2. Company/We/Us: Refers to Taifong Huaye Co., Ltd.
  3. User/You: Refers to any individual or organization that downloads, installs, registers, logs in to, or uses this App and its services.
  4. Account: Refers to the credential you obtain after registering on this App, used to log in and use this Service.
  5. Travel Product/Service: Refers to products or services actually provided by third-party service providers (such as airlines, hotels, travel agencies, attraction operators, car rental companies, etc.), including but not limited to air tickets, hotel accommodations, tour packages, attraction tickets, transportation, visa processing assistance. MongThai acts as an information display and booking platform.
  6. User Content: Refers to any content you create, upload, copy, publish, or disseminate while using this Service, including but not limited to account avatars, names, user reviews, images, videos, etc.

II. Scope and Content of Services

  1. MongThai is committed to building a comprehensive travel service platform, providing you with services including, but not limited to:
    • Flight information inquiry and booking;
    • Hotel and other accommodation information inquiry and booking;
    • Travel and vacation product information inquiry and booking;
    • Attraction ticket information inquiry and booking;
    • Information inquiry and booking for local activities, transportation, etc.;
    • Sharing of travel guides and user reviews.
  2. The travel products and services provided by this App are mainly supplied by legally qualified third-party service providers. MongThai, as an online service platform, is responsible for displaying product information and facilitating transactions. The specific contractual relationship between you and the third-party service provider shall be governed by the agreement reached between you and said third-party service provider.
  3. We reserve the right to adjust, suspend, or terminate part or all of the service content at any time based on business development needs, and will endeavor to notify users in advance.

III. Account Registration and Use

  1. Registration Eligibility: You confirm that when you complete the registration process or actually use this Service in other ways permitted by us, you are a natural person, legal entity, or other organization with the civil capacity appropriate for your conduct as stipulated by Thai law. If you do not possess the aforementioned subject qualifications, you and your guardian shall bear all consequences arising therefrom.
  2. Account Information: When registering an account, you shall provide true, accurate, complete, and valid personal information, and update it promptly. You shall solely bear any loss or liability arising from your provision of untrue information or failure to update it timely.
  3. Account Security: Your account and password shall be kept confidential by you. You are legally responsible for all activities and events conducted through your account. If you discover any unauthorized use or security vulnerabilities, please notify us immediately (email: services@mongthai365.com).
  4. Account Usage Restrictions: You may not lend, gift, transfer, or sell your account to a third party for use. Each account is limited to use by the registered user him/herself.

IV. User Code of Conduct

  1. You undertake to strictly comply with Thai laws and regulations, social public order and good customs, and the provisions of this Agreement while using this Service.
  2. You shall not use this Service to engage in any of the following activities:
    • Opposing the fundamental principles established by the Constitution, endangering national security, honor, and interests, inciting subversion of state power, overthrowing the constitutional monarchy, inciting secession, or undermining national unity;
    • Promoting terrorism, extremism, or inciting criminal activities;
    • Acts that insult or defame the King, Queen, Heir-apparent, or Regent of Thailand;
    • Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
    • Disseminating obscene, pornographic, gambling-related, violent, murderous, terrifying information, or information that incites criminal activities;
    • Insulting or defaming others, infringing upon others' rights to reputation, portrait, privacy, intellectual property, and other legitimate rights and interests;
    • Publishing, transmitting, disseminating, or storing content that infringes upon others' intellectual property rights, trade secrets, and other legitimate rights;
    • Publishing false information or publishing information by impersonating others;
    • Reverse engineering, reverse assembling, reverse compiling this App, or otherwise attempting to discover the source code of this App without our written permission;
    • Using this App or Service for any behavior that may adversely affect the normal operation of the Internet or mobile network;
    • Other acts that violate Thai laws and regulations, policies, social ethics, or this Agreement.
  3. You are responsible for the content you publish on this App (such as reviews, travelogues, etc.) and guarantee that such content does not infringe upon the legitimate rights and interests of any third party. For the content you publish, you grant us a worldwide, royalty-free, non-exclusive, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content.

V. Booking, Payment, and Service Terms

  1. Product Information: The travel product information displayed on this App (including price, availability, service standards, etc.) is provided by third-party service providers. We will make every effort to ensure the accuracy of the information but cannot guarantee it is completely error-free. The final information shall be based on what is confirmed between you and the third-party service provider.
  2. Booking Process: When booking travel products through this App, please carefully read and confirm important information such as product details, price, and cancellation/amendment policies. Once an order is submitted and payment is successfully made, it is generally considered that a contract between you and the respective third-party service provider has been formed.
  3. Payment: You shall complete the payment according to the payment method and deadline indicated in the order. Payment services may be provided by third-party payment institutions we cooperate with.
  4. Cancellation and Amendment Policy: The cancellation, modification, and transfer policies for different travel products (such as air tickets, hotels, tour packages, etc.) are formulated by each third-party service provider and vary significantly. Please be sure to carefully read and understand the relevant policies before booking. MongThai will assist you in communicating with third-party service providers regarding cancellation and amendment matters, but the final outcome depends on the third-party service provider's policy.
  5. Travel Documents and Visas: You are responsible for ensuring that you hold a valid passport, visa, and other necessary travel documents. You shall bear any losses incurred due to document issues preventing travel. MongThai may provide visa consultation or agency service information but is not responsible for the visa outcome.
  6. Travel Insurance: We strongly recommend that you purchase appropriate travel insurance according to your needs to cover potential risks during your trip, such as accidents, illnesses, and trip cancellations.

VI. Intellectual Property Rights

  1. All intellectual property rights in the content contained in this App, including but not limited to trademarks, logos, text, images, audio, video, software, interface design, and layout framework (excluding user-uploaded content), are owned by Taifong Huaye Co., Ltd. or relevant rights holders.
  2. Without the written permission of us or the relevant rights holders, no one may use, copy, modify, disseminate, decompile, or otherwise infringe upon the aforementioned intellectual property rights in any way.
  3. For the content you publish on this App that is protected by intellectual property rights, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content (in whole or in part) worldwide, and/or to incorporate it in any other works, media, or technology now known or later developed.

VII. Privacy Policy

We value the protection of your personal information. Regarding how we collect, use, store, share, and protect your personal information, please review and agree to our separately published "MongThai Privacy Policy." This Privacy Policy is an integral part of this Agreement. You agree and authorize us to process your personal information in accordance with the "MongThai Privacy Policy."

VIII. Third-Party Links and Services

This App may contain links to third-party websites or services. These links are provided for user convenience only. We assume no responsibility for the content, products, services, or privacy policies of these third-party websites or services. When accessing and using these third-party links and services, you must exercise your own judgment and assume corresponding risks.

IX. Disclaimer

  1. This Service is provided on an "as is" and "as available" basis. We do not guarantee that the service will meet your requirements, nor do we guarantee that the service will not be interrupted, and we make no guarantees regarding the timeliness, security, or accuracy of the service.
  2. We shall not be liable for service interruptions or other defects caused by force majeure (including but not limited to natural disasters, wars, strikes, government actions, communication line failures, hacker attacks, viruses, etc.) or reasons beyond our control, but we will endeavor to minimize the losses and impact caused to you.
  3. MongThai, as an information service platform, does not assume any warranty responsibility for the quality, safety, legality, etc., of products or services provided by third-party service providers (such as airlines, hotels, travel agencies, etc.). Any dispute or claim arising between you and a third-party service provider shall be resolved through negotiation between you and that third-party service provider, and we will provide necessary assistance.
  4. You understand and agree that while using this Service, you may encounter risks from network information or other user behaviors. We are not responsible for the authenticity, applicability, or legality of any information, nor are we responsible for damages caused to you by infringing acts.

X. Limitation of Liability

To the maximum extent permitted by applicable law, Taifong Huaye Co., Ltd., its affiliates, directors, employees, agents, or partners shall not, under any circumstances, be liable for any indirect, incidental, special, consequential, or punitive damages (including but not limited to loss of profits, data loss, loss of goodwill, or other intangible losses) arising from your use or inability to use this Service, even if we have been advised of the possibility of such damages.
In any event, our total liability to you, for any reason whatsoever and regardless of the form of action, will at all times be limited to the total amount of fees, if any, paid by you to us for the use of this Service during the twelve (12) months preceding the claim.

XI. Amendment and Termination of Agreement

  1. Amendment of Agreement: We reserve the right to amend this Agreement and related rules from time to time based on business development and changes in laws and regulations. The revised agreement will be published within this App and will take effect from the date of publication. If you continue to use this Service after the revised agreement takes effect, it means you have accepted the revised agreement. If you do not accept the revised agreement, please stop using this Service immediately.
  2. Termination by User: You may terminate this Agreement at any time by deactivating your account through the channels provided by this App.
  3. Termination by Company: If we find that you have violated any provision of this Agreement, or as required by laws and regulations, or if we believe your actions cause or may potentially cause harm or risk to the Company, other users, or third parties, we reserve the right to, at our sole discretion, suspend or terminate the provision of part or all services to you, or deactivate your account, without prior notice.

XII. Governing Law and Dispute Resolution

  1. Governing Law: The formation, validity, interpretation, performance, amendment, and dispute resolution of this Agreement shall be governed by the laws of the Kingdom of Thailand.
  2. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to this Agreement shall first be resolved by the parties through friendly negotiation. If negotiation fails, either party shall have the right to submit the dispute to a court of competent jurisdiction in Thailand for resolution through litigation.

XIII. Notices

  1. Any notices related to this Agreement may be delivered by us through in-App announcements, push notifications, the email address, or mobile phone number you provided during registration.
  2. Notices sent electronically are deemed delivered upon successful transmission. Notices made via in-App announcements are deemed delivered at the time of publication.

XIV. Miscellaneous

  1. Severability: If any provision of this Agreement is, for any reason, wholly or partially invalid or unenforceable, the remaining provisions of this Agreement shall remain valid and binding.
  2. Entire Agreement: This Agreement (including the "MongThai Privacy Policy" and other rules we may publish from time to time) constitutes the entire agreement between you and Taifong Huaye Co., Ltd. regarding this Service, superseding all prior oral or written agreements, understandings, or representations between the parties on the same subject matter.
  3. Headings: The headings of all clauses in this Agreement are for convenience of reading only, have no actual meaning themselves, and cannot be used as a basis for interpreting the meaning of this Agreement.
  4. No Waiver: Our failure or delay in exercising any right, power, or privilege under this Agreement shall not operate as a waiver thereof.
